Court of Appeal reopens $7 bn Brazil dam lawsuit against BHP

Extraordinary news today regarding one of the largest group claims in English legal history.

 Mariana & Ors v BHP plc and BHP Ltd was brought by law firm PGMBM on behalf of 200,000 Brazilians following a dam rupture in 2015 that led to Brazil's worst environmental disaster.  

It was initially struck out by the lower court as an abuse of process last November and a Court of Appeal judge upheld that decision in March.

However, today the CoA unanimously agreed that 'the appeal has a real prospect of success.'

It'll be interesting to see how the appeal develops and what this means for similar cases looking to have such actions heard in the English courts.

Tom Goodhead, a PGMBM managing partner, said it was a "monumental judgement" and that his clients felt this was the first time judges had recognised the importance of the case.
